1. Acceptance of Terms
By using NoteCarry (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. What NoteCarry Is
NoteCarry is a software platform that helps individuals record, track, and facilitate payments on privately held seller-financed notes. NoteCarry is not a licensed loan servicer, mortgage servicer, escrow company, bank, or financial institution. NoteCarry does not provide legal, financial, or tax advice.
3. What NoteCarry Is Not Responsible For
- NoteCarry does not guarantee that borrowers will make payments
- NoteCarry does not take enforcement action on delinquent loans
- NoteCarry is not responsible for the legal validity of any loan agreement
- NoteCarry is not responsible for compliance with state or federal lending laws
- NoteCarry is not liable for disputes between lenders and borrowers
4. User Responsibilities
You are responsible for:
- Ensuring your loan complies with applicable state and federal laws
- The accuracy of loan terms entered into the platform
- Reviewing and confirming all AI-extracted document data before saving
- Any legal action required to enforce your loan
5. Payment Facilitation
Payments are processed through Stripe. NoteCarry never holds user funds. By connecting a bank account, you agree to Stripe's Terms of Service. NoteCarry charges $20/month per active loan. The first month is free. Billing continues until you cancel or the loan is marked as paid off.
6. Data and Privacy
Your use of NoteCarry is also governed by our Privacy Policy.
7. Limitation of Liability
NoteCarry's total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to NoteCarry in the 3 months preceding the claim.
8. Indemnification
You agree to indemnify and hold NoteCarry harmless from any claims arising from your use of the Service, your loan agreements, or your violation of these Terms.
9. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
